Why doesn’t the UK have an equivalent to the US bankruptcy code’s Chapter 11 – particularly for the small and medium enterprise sector, where, like it or not, many firms are going to fail?  And, given the importance of that sector to UK plc in terms of job creation, innovation and entrepreneurialism, wouldn’t it be great if we were able to remove the stigma of failure that goes with conventional bankruptcy and corporate liquidation?
